How long do I have to file a car accident claim in Illinois?

In most cases, Illinois law gives you two years from the date of the crash to file a personal injury lawsuit (735 ILCS 5/13-202). Some claims — like those against a city or government entity — have much shorter deadlines. Evidence disappears fast, so the sooner you talk to a lawyer, the stronger your case.

What if the other driver doesn’t have insurance?

Illinois requires every auto liability policy to include uninsured motorist coverage, and many drivers also carry underinsured motorist coverage. That means you may still be able to recover through your own policy. We review every policy that could apply to your crash to identify the coverage available to you.

Can I still recover if the accident was partly my fault?

Usually, yes. Illinois follows modified comparative negligence: as long as you were 50% or less at fault, you can recover — your award is simply reduced by your percentage of fault.
